Applications by farm wineries, pursuant to subdivision 42 of section 16 of the Agriculture and Markets Law and subdivision 5 ofsection 76-a of the Alcoholic Beverage Control Law for authorization to manufacture or sell wine produced from grapes grown outside New York State; and certifications as to the quantity of New York grown grapes unavailable due to natural disaster, act of God or continuing adverse weather condition shall be made using the following form: STATE OF NEW YORK

entire FARM WINERY CERTIFICATION AND APPLICATION FOR AUTHORIZATION
TO UTILIZE GRAPES GROWN OUTSIDE NEW YORK STATE consists of a total

(3) I agree to comply with all New York State and Federal laws and
regulations regarding the labeling of wine and the approval of wine
labels and acknowledge that, pursuant to such laws and regulations,
if less than 75 percent of a wine is derived from grapes grown in
New York State, such wine cannot be labeled with the New York State
appellation of origin or with the appellation of any region within
New York State.
(4) I agree not to utilize more out-of-state grown grapes than the
amount of New York State grown grapes that I am unable to obtain
due to their destruction by natural disaster, act of God or
continuing adverse weather condition.
(5) I agree, that in manufacturing wine, I will utilize grapes grown or
produced in New York State to the extent they are reasonably
available, prior to utilizing grapes from an out-of-state source
for such purpose.
